On January 9, 2024, Judge Florence Y. Pan presented very specific hypotheticals regarding what, if any, limitations there are, on a sitting President, regarding acts committed while in official Office. Judge Pan was inquiring into whether a President can be prosecuted for some things, or alternatively, does the President enjoy sweeping Presidential Immunity? Judge Pan chose to use scenarios such as a sitting President selling military secrets (Espionage) or using SEAL TEAM 6 to Assassinate a rival (Wet Ops).

The scenarios presented by Judge Pan create a question that was already asked by a former Government judge, Randi Lynn Erickson, Minnesota, when Erickson sought relief from the U.S. Court due to kidnap, rape, torture, murder, and bestiality threats she and/or Timothy Charles Holmseth were receiving."
